1Acceptance of these terms

By accessing, using, or registering on the Zainab Properties platform, you agree to be bound by these Terms & Conditions, our Privacy Policy, and our Cookie Policy. If you do not agree, please do not use the platform.

You confirm that you are legally an adult (18 years or older) and competent to contract in the Kingdom of Saudi Arabia, or that you use the platform under a valid power of attorney.

2Services and their scope

The Company provides a digital real-estate platform that includes, without limitation:

• Showcasing approved residential and commercial properties for sale, rent, and off-plan development.
• REGA-licensed brokerage services including property matching, negotiation, and registration through official systems (Ejar and others).
• Supporting tools such as the mortgage calculator, initial valuations, and after-sale services.

3Property information

We make reasonable efforts to verify the accuracy of listed properties, including official documents (title deeds, building permits) through the Ministry of Justice and official registries. However:

• Images, descriptions, and areas are indicative and minor variations are subject to final agreement.
• You are responsible for performing due diligence (site visits, title-deed verification, matching requirements) before completing any transaction.
• Advertised prices are in Saudi Riyal (SAR) and may or may not include VAT (15%) and fees as set out in Clause 5.

4Accounts and your responsibilities

• You must provide accurate, complete information at registration and update it promptly when it changes. NSSP (Absher)-verified data is subject to identity matching.
• You are responsible for keeping your login credentials confidential and accept responsibility for all activity under your account unless you prove otherwise.
• Automated accounts or identity impersonation are prohibited; we may suspend any account breaching these terms without prior notice.

5Fees and commissions

• Brokerage commissions are governed by the signed contract and comply with approved regulatory caps in the Kingdom; they are disclosed in writing before the transaction closes.
• VAT (15%) applies to fees and commissions under ZATCA requirements, with approved electronic invoices (Fatoora) issued.
• Government fees (registration, title transfer, Ejar/Nafath attestation) are collected on behalf of the relevant authorities and documented in the contract.

6Intellectual property

All content on the platform — including text, images, designs, trademarks, and software — is owned by the Company or its licensors and protected by KSA intellectual-property laws. Copying, republication, or commercial use of any content without prior written permission is prohibited.

7Limitation of liability

• The platform is provided "as is" to the fullest extent permitted by law, without any guarantee of uninterrupted or error-free operation.
• The Company is not liable for indirect or consequential damages (such as loss of profits or opportunities) arising from platform use.
• Nothing in this clause excludes liability that cannot or may not be lawfully excluded, such as liability for gross negligence, fraud, or statutory breaches.
• The Company is exempt from liability during force majeure events (natural disasters, network outages, official decisions).

8Governing law and disputes

These terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Disputes arising from these terms or the use of the platform shall first be subject to amicable settlement; failing which, they shall be referred to the competent courts in Riyadh, with the option of commercial arbitration under applicable KSA regulations.

9Changes to these terms

We may update these terms from time to time to reflect regulatory and service developments. Material changes will be notified by e-mail or on-platform notice at least ten (10) days before they take effect; continued use of the platform after the effective date constitutes acceptance.
